Intellectual Property Claims on Amazon

Your product photos or texts appear on another seller’s listing, someone is offering products under your brand without authorization, or you spot a product that copies a protected one.

Who this is for

Brands, manufacturers, photographers and creators whose rights are being used without authorization on Amazon, whether or not they sell there.

Amazon’s official routes

  • Public notice form: available to any intellectual property rights owner or their agent.
  • Report a Violation, within Amazon Brand Registry: available to brands enrolled in Brand Registry, from an account assigned the Rights Owner or Registered Agent role. A brand enrolled with a pending trademark cannot use this tool until the mark is registered.

Brand Registry is not required to file a claim, and it is not something Jurix can grant: Amazon runs it under its own requirements. If your brand is eligible, I assist you in using its tools.

A seller’s offer or the product listing?

A claim can target specific sellers’ offers or the product (ASIN) as a whole. The choice matters: a poorly framed claim may be rejected or affect sellers who are not infringing.

What is not infringement

Reselling genuine products, distribution disputes and pricing disagreements are not, by themselves, intellectual property infringements. Using IP mechanisms for those purposes may be treated as abuse and have consequences for the claimant.

What is included

  • Analysis of allegedly infringing images, texts, products, offers and listings.
  • Distinguishing a claim against an offer from a claim against a listing or ASIN.
  • Use of the official mechanisms available according to ownership, authorization, marketplace and eligibility.
  • Assistance with Brand Registry tools when the client meets the requirements.

Limits

  • Amazon decides on each claim; results, timeframes and account closures cannot be guaranteed.
  • Each Amazon marketplace may have its own requirements, and the right invoked must cover the relevant territory.

Hypothetical example

Hypothetical example: an Ecuadorian cosmetics brand with a trademark registered in the United States discovers that another seller is using its product photos on a different listing. The ASIN is identified, authorship of the photos is established, and a copyright claim is filed through the appropriate route.

Documents to start the assessment

  • ASIN and links to the listings or offers.
  • Trademark registration number, the issuing office and the goods it covers.
  • Original photo or text files.
  • For suspected counterfeits, any available evidence, such as a test purchase.

How I work

  1. Initial assessment. We review what was published, where, and which right may be affected.
  2. Review of rights and evidence. We verify ownership, licenses, authorizations and proof.
  3. Choice of route. We select the appropriate mechanism: platform, provider, search engine or direct demand.
  4. Authorized preparation and filing. I prepare the claim and file it only with your express authorization.
  5. Follow-up. I handle responses, requests for information and rejections.
  6. Next steps. If there is a counter-notice, a re-upload or a refusal, we assess the alternatives.

Frequently asked questions

  • Do I need Brand Registry to file a claim? No. The public form is open to any rights owner or agent; Brand Registry adds tools for enrolled brands.
  • Is a trademark registered only in Ecuador enough? It depends on the marketplace and the territory the mark protects. We review this at the outset.
  • How long does Amazon take to respond? It varies and cannot be guaranteed.
